Class action law suit registration: Private Citizens vs. SAPS
I had a chat with a very well known member on this board yesterday.
Lets see who want to join us in a Class Action Law Suit against SAPS. A private individual (the man on the street) class action law suit. Lets fight back for our licenses and our competency certificates that take forever. I'm sick and tired of poor service delivery. We can maybe even look at the printing of cards? Who wants to join this fight? Maybe some of our resident lawyers can guide me here. If we join forces we split the money for the legal fees. The more members we get the cheaper we pay.
Course of action:
1) We register on this thread.
2) We use 1 month from this date to build up a registration data base.
3) We select a law firm (with guidance from our lawyer members).
4) We pay our fees according to the member count.
5) If we need another month to get more members we extend registration time.
6) We do not back down, we have to see this through and it have to go to court to get a ruling. Even if they do agree to settle everything for us out of court.
7) We have rights we have courts!
8) Lets kick some ass!
9) Once you register I will pm you for more details.
10) Remember the more we are the cheaper it becomes.
11) Please feel free to comment and make suggestions.

if i can afford it im in, but where ow where are the other 500 members for a class action ? Dont think 3 qualifies?

There is a law firm in Pretoria that specialises in suing the government and particularly the Minister of Police. More importantly, they take on cases on a contingency basis (they are prepared to collect their fees and the fees of senior counsel) from out of the settlement that you are awarded if the case is successful).
They 'may' be interested in taking this case on. I have contact with one of their directors. Would you like me to take discussions further?

I like your initiative. I am not a legal person, so I stand to be corrected, but logically I would think that we want to set a precedent to pave a way for sustainable change.
So, we should consider what approach will give us the highest probability of winning the case.
For example, arguing five diff scenarios will take more time and money than a surgical scalpel intervention. I.e. we should be very specific what we want. The Act is fairly specific as to requirements and CFR boxed us into categories: SD, DS, DH, OS, OH...
So, in my mind we have to focus on the highest probability scenario that cannot be easily dismissed, I.e. DH or DS. I say that because SD apps are of diff competency level and diff circumstances, e.g. student living in Sunnyside will have diff profile to ex cop living on a plot. One can almost understand that thorough eval of application and circumstances is required.
DH or DS is more clear cut. It is a specific firearm for specific purpose within the regulatory framework.
It should be quicker case with fewer arguments back and forth, cost us less and pave the way for process improvement.
What is your view?
Paul, looks like you have the right firm for the job. What are the alternatives? If we club in I would want the best.
