East London - Three youths were arrested after they allegedly attempted to rob schoolchildren with a fake gun in Duncan Village, Eastern Cape police said on Monday.

"They pointed a firearm at kids coming out of school and robbed them," Captain Stephen Marais said.
He said the youths, aged 16, 17 and 18 respectively, allegedly pointed the replica firearm at a child, but he had nothing they could take.

A second child was stopped, and as he was about to hand over his cellphone and other belongings, a taxi driver stopped and shouted at the robbers.
Marais said the three ran into nearby bushes to hide.

The K9 dog unit was called in at 14:45 to assist in their arrest, but after several verbal warnings they refused to co-operate, Marais said.
Police used the dogs to apprehend the youths.

Ambushed

"They could have ambushed our policemen. (We) had to use all precautions."
Their parents were informed and they were taken to a hospital for treatment for dog bites.

Upon inspecting the gun, police established it was fake.

"If you look at it, it looks like a real, genuine firearm. It weighs the same."
Marais explained that, under the Firearms Control Act, even in the case of a replica, if a victim perceives it as being real the case is classified as armed robbery.

The three pupils, one from Lumko High School and two from Mzokhanyo High School, were due to start their exams later this week.

However, due to the nature of the crime they could not be released.

They would appear in the East London Magistrate's Court on Thursday on charges of armed robbery and pointing a firearm at a person.

Nothing to do with the FCA. Everything to do with the common law crime of robbery.

The FCA makes pointing a firearm, or something that appears to be a firearm, a crime. Its a seperate crime to robbery.
