Procedure for firearms after death
Hi All,
What is the procedure to follow to transfer, sell or destroy firearms legally owned by a loved one once they pass away?
Does it make a difference if the firearms are under the new or old licenses?

The executor can be in possession of the guns by virtue of his appointment as such. He steps into the shoes of the deceased. He can sign all the necessary forms to transfer to purchasers, shops, cops, beneficiaries etc.

Thanks for the fast reply SSP.
My First question is does the SAPS and the CFR know that the executor can carry out these duties before they try and lock you up for fraud or something?
If there is no executor for the estate, what is the procedure then?

They should do, its in the act.

I was once in the unenviable position of a deceased having donated a rifle to the Defence Force for some historical reason... only for it to come out after the death of the deceased 20 years later that the Defence Force had never taken proper transfer of ownership of the rifle...
What a mission to get it transferred to them... well first to find the damn rifle... which had moved to Kimberley in the intervening years! Then needing to find someone bright enough to understand the predicament... I must say that once the Army figured out their mistake their ability to organize the transfer was breathtakingly quick! I suspect that guys in brown with high ranks may make Director Jaco Bothma's balls shrink... and his head involuntarily nod assent vigorously...

If the plan is to transfer ownership of the firearm from the estate to, for example, a family member, then the executor is responsible for the firearm until transfer is complete. If the executor has not got the correct facilities (i.e. a safe), he cannot take possession of the firearm and it should be checked into a gun shop for storage.
