    Exclamation Re-licensing? AVOID THIS TRAP!!!

    Armed citizens take note: if you're due to re-license your white (New Act) license, make sure you have ALL the required docs attached.

    Many gun owners are being misled to think that SAP518a (renewal form) is sufficient, and since it doesn't provide space for any motivation, many people think that no motivation is required.

    THIS IS FALSE!!!

    There exists an "ANNEXURE A" to the renewal form. On this annexure you have to supply many particulars, including a detailed motivation (just as you did when you first applied for the license). You basically have to show that you've actually used your gun for the purpose which you got it for in the first place. In the case of self-defense guns, you have to show that your circumstances haven't changed.

    Of course, in their typically dishonest and deliberate style, the SAPS have not made this form available on their website along with the other application forms, and they seldom breathe a word about it to anyone who submits their application. Most stations don't even carry the annexure in stock. Many gun-owners have already been misled into submitting a renewal app without the motivation, and many will no-doubt be slapped with a license refusal claiming "Insufficient motivation".

    Oh joy!! They are backlogged and have not finished the first 5 year round of applications and the next lot is starting to come in. At this rate they will fall further behind every five years and, in 15 years, they will be backlogged for half a century. One would have to apply for a license at birth if you want to hunt or target shoot in your retirement years.

    This is fantastic will have to set up a reminder chart on the fridge when all the different licenses expire. Firearm competencies and licenses, car licenses if you don't get reminders, drivers licenses, TV licenses and post box renewals, passport renewals holy shit can become confusing need to get some planning system going.

    Just bugs me you have to go through all this shit again, I am sure this takes years off your life just in frustration not to mention the amount of money spent!!

    Renewal of firearms licenses in terms of section 24 of the firearms act. Act 60 of 2000

    The purpose of renewing firearms licenses is only to determine if the licensed holder still complies with the provisions of the Act and the Firearms Control Regulations, 2004.

    Chapter 6 : Licence to possess firearm
    24. Renewal of firearm licences

    1) The holder of a licence issued in terms of this Chapter who wishes to renew the licence must at least 90 days before the date of expiry of the licence apply to the Registrar for its renewal.

    2) The application must be—

    a) accompanied by such information as may be prescribed; and

    b) delivered to the Designated Firearms Officer responsible for the area in which the applicant ordinarily resides or in which the applicant’s business is, as the case may be.

    3) No application for the renewal of a licence may be granted unless the applicant shows that he or she has continued to comply with the requirements for the licence in terms of this Act.

    4) If an application for the renewal of a licence has been lodged within the period provided for in subsection (1), the licence remains valid until the application is decided.


    On form SAPS 518(a) the DFO (not the applicant) must motivate if the applicant still complies with the provisions of the FCA.

    Self Defence - So how did you comply with this purpose exactly?
    Hunting
    Sport Shooting

    Who cares to clarify this one? Maybe I'm having a blonde moment.

    If you complied with the provisions of Firearms Control Act 60 of 2000 what else is there to motivate?

    That you are still older than 21
    That you have not been found guilty of any criminal offence.
    That you have not become a victim of drug and alcohol abuse.
    That you have complied with the Domestic Violence Act.

    Note - There nothing about also having to complete any Appendix A to form SAPS 518(a)

    This borders on entrapment. Omitting this requirement in the official instructions is persuasion by law enforcement officers or their agents to commit a crime that an applicant had no previous intent to commit; and the law as a matter of policy forbids conviction in such a case.

    Good post P35.
    My question is what will happen if say God forbid you forgot to renew a specific licence say for SD and you hand in a renewal after it has expired. Take into account this will happen if you just think of the amount of people who let there drivers licence expire.

    Now you tick the specific box and your reason is I forgot (dont lie on the application). Will the DFO just plain refuse for you to reapply (renew)?

    What's your options you are now in possesion of an illegal firearm?

    SAPS Circular dd 2010-08-26 does not require the completion of any appendix to SAPS 518(a) either.

    The applicant merely needs to show that they have continued to comply with the requirements for the licence in terms of Firearms Control Act, 2000

    (So identify in the FCA where the requirements are listed for your license and what they are - if you complied with those you have shown compliance with the Act)

    Besides the spelling mistakes on this document "Annexture A" it is not published in the Government Gazette and is also not part of the official documents of Regulation Gazette No. 8274, DEPARTMENT OF SAFETY AND SECURITY DEPARTEMENT VAN VEILIGHEID EN SEKURITEIT No. R. 696 16 September 2005 which lists all the OFFICAL forms approved to be used in the administration of the FCA.

    So who introduced it and why...if not published as an official document in the government gazette - how can it even be legally binding.

    Yes, it does. From the circular in the link:

    11. The following documents must be attached to the application for the renewal of the firearm licence:

    ...
    11.6 A proper motivation indicating that the applicant has continued to comply with the set requirements of the original licence (the attached Annexure "A" must be utilised for each firearm licence that is to be renewed).
