Default Psychiatric: Anxiety and Depression? : worried I get a refusal

    Hi ppl

I'm busy filling in the SAPS 517 form for a re-license. I would love some help and advice from forum members, and possibly from people in the CFR or DFO's.

    I'm worrying about question 13 and 14, (on page 5 of 11), which read as follows;

    13. In the past five years did you threaten or attempt suicide, suffered from major depression or emotional problems, or engage in intoxicating or narcotic substance abuse (Indicate with an x)

YES/NO . If yes, submit details

    14. In the past five years have you been diagnosed or treated by a medical practitioner for depression, drug, intoxicating or narcotic substance abuse, behavioural problems or emotional problems? (Indicate with an x)

YES/NO . If yes, submit details

Now, I did go see a psychiatrist, who treated me for anxiety and depression.

I asked the helpful guy where I did my SASSETA test, whether I should just not keep quiet about it, He said No, if Police find out you will be charged. I said I wondered if I could get a letter from my doctor regarding my condition, He said it was a good idea. He implied that if the doctor was happy you are ok, it was unlikely you get a refusal on medical grounds. The doctor doesn't need to reveal what you were treated
    for.

I also spoke to my DFO about what to do, as I have to answer yes to the questions (and submit details).
I told him I believe that you have to get a report from your doctor regarding whether you have a stable mental condition and whether you are inclined to violence. He told me to get a letter from the doctor. The DFO also felt that it's unlikely I get a refusal if all was in order in the letter. The DFO also asked me if I wouldn't mind me telling him what I saw the doctor for. Wanted to know if it was due to a relationship problem, to which I said it wasn't. Other than that, the DFO seemed happy with me.

I subsequently asked the doctor for a report, doc gave me a letter stating to the effect that

    a)I am mentally stable,
    b)I have never been violent.

    My questions are:

    a) Will I get an automatic refusal? What's to be done if they do refuse?

    b) Is the doctor's letter sufficient motivation / evidence for the DFO and CFR ?

    c) what kind of details do I submit in Q13 and Q14? do I write "see doctor's report" or must I also state the condition eg "Anxiety;Depression" ?

    Tia

    PS:

I'm posting anonymously as I'm scared of getting unwanted attention from anti-gunner types like looking for "evidence" of "mental" people applying for guns. Also I don't like the general prejudice people display against those who seek medical help for a psychological condition. Most of us are quite normal, non-violent people.

I would suggest speaking with SSP and Khumba on this but if a doctor (psychologist) provides a more recent opinion than the one provided at time of treatment I do not see a legal reason why the most recent opinion would not be considered the most valid opinion

I think that CFR puts a lot of stock in the DFO's recommendation.

Im not sure that your psychiatrist can say that you have never been violent. I think that he can only say that your condition does not render you prone or predisposed to violence.

I'd give details as to what you were treated for and whether you are still being treated for that condition.

I'd also give details about how your condition and its treatment will have no impact on your fitness to possess arms.

The more detail you include, the more ammo you will have if you have to appeal.

I know someone very well, that was treated for depression, he submitted all the Dr.Papers etc. Re licensing, no problems, new license application, 3 I think was approved no problem, so he chose the honest and correct route, and all went well, as far as my memory goes the last couple of new licenses was approved very recently.

    Hi, my first post here.

I have personal experience of your situation as I have been treated for depression. I answered the application truthfully and it was returned with a request for a doctor's opinion regarding my mental fitness to own a firearm.

I went my GP and got the note and submitted it along with my application.

I received notice this week that my renewed licence is ready for collection.

What is wrong with this picture?

Does anyone see a massive constitutional issue here - invasion of privacy issues perhaps?

I don't think it's invasion of privacy on this issue.

Do not lie on the question and answer it correctly. Get a letter from the Psychiatrist stating the situation and his opinion about you and if he thinks you are fit to have a firearm. This question is not to automatically declare you unfit but to explore this issue and get relevant information. Rather play open cards and take the safe route. This is just a possible item that can count against you but not a automatic issue.

On the issue raised about invasion of privacy....I would prefer this and thus getting a best as possible picture about the applicant than not having this information available and issuing licenses to unfit people due to mental unstable issues.
