applying for a licence
Hallo all
I want to apply for my first SD pistol, but i have some questions.
About a year ago some NUT falsely accused me of pointing a gun at him.
Went to court a few times and everytime they set another court date because
this NUT did not show. Eventually he pitched an withdrew the case.
Now my question is, will they give me a competency certificate?
Because i heard you must not have any record of aggression against someone
or does this not apply if he withdrew the case?

If you were not convicted in court, then there is no record and you cannot be denied a firearm licence for that.

HI
My advise is , you must mention the case on the application form , and if possible get the charge sheet to prove that the case was withdrawn by the complainant as if for some reason they pick it up on the system you have jeorpadised every chance you had for obtaining the licence and again If I may ask were you arrested and fingerprints taken or not? Mentioning the case also proves to them that you are honest also your motivation must be great do not give them any reason to decline it, try closing every angle they may refuse the licence on. You can google more information of why licences get refused then write your motivation closing those angles and indeed motivating your application to the best of your ability.

Not sure if I agree that you must mention it. You were NOT convicted and the case has been withdrawn, and so there is absolutely no obligation to mention this.
I also don't think that mentioning it will prove to these clowns that you are honest. Remember, they will scrutinise your application for any reason to NOT grant you a licence.
Not being argumentative, just giving my opinion. Good luck with the application.

Best suggestion I can make is make an appointment with a lawyer who knows this field. It will cost a bit but could save you some serious ball ache down the line.

I coincidentally spoke to our local DFO Supt. this morning about the very same question. He told me that it is not necessary to mention any criminal cases that was withdrawn You only have to mention all your pending cases and cases in which you were convicted or paid an admission of guilt fine.
To be 100% sure phone Pretoria CFR and ask them.

This is the newer electronic system that they're using right?
I wonder how up to date their database is. The system isn't all that old and they'd have to scan in old fingerprints from decades ago or are they only scanning against cases since the system was introduced?
What about unsolved crimes, are they scanning against them (assuming they're in the new system) in order to weed out potential firearm owners who've never been caught for their previous crimes?
