    Exclamation Media statement by JASA

    Dear Friend

    Following an application by the Justice Alliance of SA (JASA) and the False Bay Gun Club, the Western Cape High Court gave Police Minister Mthethwa 90 days to draw up guidelines for compensation for firearms surrendered, to the State, under the Firearms Control Act.

    After the Sate published 'guidelines', JASA declared: "After consultation with Senior and Junior Counsel JASA will take the Minister of Police back to the Cape High Court …alleging that the Guidelines issued by him do not comply with the order of the Court made on August 31, and do not comply with S.137 (5) of the Firearms Control Act."

    John Smyth, JASA Executive Member, also pointed out on television
    that this compensation case goes to the root of the rule of law and if the Executive defies Parliament and the courts, we are on the road to Zimbabwe.

    This case is of interest to all South Africans. It is all about the rule of law, the States adhering to the Constitution, the right to own property and the dishonouring of the pledge Ministers swear to uphold the Constitution.

    Workers have lost their jobs and entrepreneurs their businesses because of this law. The elderly have been treated with disrespect when attempting to claim compensation. Others have lost their lives when found defenceless after handing in their weapons due to police threats of arrest if they did not comply with this immoral law.

    Please show your solidarity and support of our friends at JASA and the False Bay Gun Club by helping them finance this case.

    This thread needs to become a sticky ASAP! We all need to pitch in here. Will be sure to make my contribution.

    Edit: Maybe even a highly visible banner on top of each forum page pointing to this thread: "JASA CASE DONATION INFO" or something similar.

    Just received the info from John:
    The Judge will make his order in open court tomorrow but not read the judgment. 0945. Cape Town High Court.
    I will email you the result later in the morning. We expect to get a copy of the full judgment either tomorrow or next week.

    I am sorry to tell you that the judgment this morning was not all that we had hoped for. The judge did strike down some of the less important guidelines relating to the compensation payable (and the costs assessment) in cases where the State kept the gun for its own use. He did not however find for us on the important issue of whether compensation must be paid in every case where a lawfully held gun is surrendered voluntarily.

    There is some ambiguity in the order which counsel felt may need to resolved by the judge.

    There was no order for costs.

    However as soon as our senior counsel can study the judgment and consult with us, we will get back to you. An appeal has to be lodged within 14 days.

    AARGH....What does this mean? I suppose then that "voluntarily" becomes the question. Is the weapon handed in truly voluntarily or after much propaganda, and threats of all sorts of nastiness.
