Class Action
We at GunSite, with our similar interests, constitute a community.
We have been keenly aware of the absolute frustration that some community members have been feeling with various unacceptable aspects of the firearms licensing regime, as it is currently enforced.
Let us be clear. We accept the law as it stands, and take issue with aspects which, in our opinion, are not being correctly enforced as per the FCA.
Some of these issues are:
1. Inordinate delays in the processing of license applications: more than 3 months; more than 6 months; more than 9 months
2. Inordinate delays in competency certificate applications being considered: more than 3 months; more than 6 months, more than 9 months;
3. Inordinate delays in the getting of refusal letters: more than 3 months; more than 6 months; more than 9 months;
4. Inordinate delays in waiting for license cards: more than 1 month; more than 3 months;
5. Ridiculous reasons for refusals that is not justifiable in terms of the Act;
6. Appeals taking longer than the prescribed times;
7. DFO / CFR refusing to accept applications for temporary authorizations;
8. Temporary authorizations taking longer to process than: 2 weeks; 1 month; longer
9. Refusals for temporary authorizations (Sec 21)
We have therefore agreed to fully support GOSA, who have in consultation with a team of attorneys and counsel agreed to begin launching a series of High Court applications on behalf of various classes of affected individuals, under the auspices of GOSA as a firearms rights organisation.
The purpose of these applications is to clarify issues and obtain relief on specific performance issues. Each of these applications, will have as it's objective the establishing of legal precedent, which will guide the SAPS in the future, by giving interpretation to issues concerned with the FCA.
The first of these applications is already underway.
Application was issued on SAPS yesterday, with a court date set for early September.
We invite aggrieved parties to come forward and express their interest to participate in these class suits.
