    Default Rightful search?

    Good day Gents.
    A family member was recently subject to a SAPS search of his home while he was away. His 12 Year old son was home alone. The cops gained entry to the property and ordered the boy to leave the house and when he refused they used force to shove him outside and commenced the search. The parents then arrived at home and a arguement broke out. The wife started to record the actions of the cops and one officer then slapped the phone from her hands. They could produce no search warrant or justification of the search. What actions can be taken? Understandably the young boy is traumatised by what happened.

    I understand, just want a opinion from some of the SMEs here to see if it is worth it to pursue

    By the sound of it, it is worth at least a first consultation with a decent lawyer. There's probably a right of action.

    This. It doesn't sound kosure, and a lawyer will be worth the money you pay for it all the way.

    no warrant = lay assault and trespassing charges against them

    Follow WZ's advice, ie a legal eagle is telling you that your bud must lawyer up asap.

    Apparently they where searching for lobster that was caught outside of what his permit allows. None was found.
