I remember reading an article in Magnum where martin hood talked of this with the Criminal Procedure act. You are allowed to shoot a fleeing suspect if:

A- Crime was serious enough and the arrest was justified
B- You were attempting to execute the citizens arrest
C- There was no chance of later arresting the suspect.

other conditions were:

Fleeing perp was threatening passersby or the arresting officer/citizen
