    Default What to do with gun in estate

    I am asking this for a friend. Her father passed away and his gun is still in their safe at home. She want to get the gun on her name, but the first issue is, the license for the gun expired since her father passed away, and she does not know if there ever was 'n green license. Next, the fact that the gun is still in their safe... I am not sure, but I think it should be in the possession of the executor of the estate?

    So the question is, what should she do with the gun at the moment to get it stored legally at least before she starts the licensing process?

    Apply for a license. When doing so have the executor sign the SAPS 271 and also submit a copy of the Letters of Executorship, a copy of the old license and the death certificate. Let the executor keep the safe key/s until the license comes through.

    She can also get a storage permit for the firearm but sometimes that depends on the DFO.

    Just give the keys to the executor or have him/'her take the item away in the meantime. Storage permits do not entitle one to use the gun.

    Storage permits are only issued to a competent person with a valid firearm licence.

    The executor must sign 271 as mentioned. You also then need to attach all copies you have of estate.
    Showing that person is the legal executor.

    Going to be somewhat of a headache to make copies of the estate.

    Perhaps then, Shooty, if you don't know, rather stick to the stuff you do know.

    I just received 2 licences from my dad's estate. The executor did not sign as I was the person in legal possession of the firearms-I am legally storing the firearm. SAPS271 require the Executor details under the ESTATE. But the person who signs is "DECLARATION BY PERSON WHO IS LAWFULLY IN POSSESSION OF THE FIREARM(S)"

    I suppose the question is who is lawfully in possession? I guess I am because the will says I get all the firearms.

    Estate papers. Showing the person is executor and able to sign.

    Strangely I handle or assist in the odd estates.
