It's possible it could hit the older guy in his right shoulder but I believe the muzzle is pointing more to the shooter's left than the 2-D photo would show.

I just laughed when I looked at the expression on the shooter’s face and the position of his right hand - it is like “come on just a little to the right and I’ll be able to make this look like an accident “
