Handed in my appeal this morning. Received refusal sms on Monday same as others "failed to convince CFR there is a need for this paricular firearm". Thought to use GOSA as I am a member but given the extreme number of refusals and on top of that the proposed amendments to the FCA it might not have been wise to pile on. Now, onto another 80 days wait :(

So, this is an extract of a first draft of the latest application that GOSA and Clark Attorneys are busy with. This follows the refusal of several license applications for members of the South African Teams over the past year that prevented them from participating internationally. The draft papers are with leader counsel for review (he will have time to look at this after Thursday next week), so some of this may still change though, but the intention is there. If leader counsel and the rest of the members of the FDD think that this is doable, then it will be a go within the next two weeks. This should be precedent setting in the sense that compensation for the damages relating to the many appeals that members put in over the years may be made possible because of this case. This is in addition to the legal costs of the review application itself. We also made mention and provided a lot of details on spurious refusals that were upheld on appeal (thanks to having records of many appeals). This include the spurious refusals for .38's that were said to be "machine guns", etc.

NOTICE OF MOTION
TAKE NOTICE THAT, on a date to be arranged with the Registrar of this Honourable Court, the Applicant intends to make application to this Court for orders:
1. Reviewing and setting aside the decision taken by the 1st Respondent on or about 19 June 2018, to refuse the Applicant’s appeal against the refusal of his application for a firearm license applied for in terms of Section 16 of the Firearms Control Act, Act 60 of 2000 (“FCA”), without the 1st Respondent having complied with the requirements of the FCA and the common law;
2. Replacing the 1st Respondent’s decision to refuse the Applicant’s appeal to it with a direction that the appeal is upheld, and that the 2nd Respondent be ordered to issue the license for the Applicant’s shotgun and that the 2nd Respondent should furnish him with the license card within 21 days of the order of this Court;
3. Ordering the 2nd Respondent to pay compensation to the Applicant in terms of Section 8(1)(c)(ii)(bb) of the Promotion of Administrative Justice Act, Act 3 of 2000:
3.1 For the specific / special damages relating to the costs to be taxed of his appeal to the 1st Respondent on a scale as between attorney and client;
and
3.2 for the specific / special damages for his losses due to the conduct of the Respondents herein as set out in this application to the value of R116 424,00;
and
3.3 for compensation in the form of general damages in the amount of R100 000,00.
4.1 Ordering the 5th and 6th Respondents to jointly and severally, the one paying, the other be absolved from payment, to pay the Applicant’s costs of this application personally, on a scale as between attorney and own client, alternatively attorney and client, alternatively ordering the 1st to 6th Respondents to pay the applicants costs jointly and severally, the one paying, the other to be absolved from payment, on the attorney and own client, alternatively the attorney and client scale;
4.2 In addition thereto to order the 5th and 6th Respondents to pay for the costs of the State Attorney and Counsel employed herein on behalf of the Respondents personally on a scale as between attorney and own client, alternatively on such a scale as the court may allow.
5. Granting the Applicant further and / or alternative relief.

They are acting as if the new proposals have been enacted. But then they are denying the importance of the status of the document at the same time.
Fraudsters and liars.
Who sabotage their own IT systems to obstruct the efficient functioning of the draconian law as it is, even further.

We're working up to a nice High Court application on these specious refusals.
First step is to get Appeals in, and get refused... sadly, but that's the game."Always remember to pillage before you burn"
