    Default Result of today's decision

    If you have failed to apply for your license in time and are now in possession of an illegal firearm, would that make you ineligible for another license? Therefore not able to buy a new firearm and losing those that you do have valid licenses for?

    I would assume that wouldn't be the case until you are found guilty in a court of being in possession of an illegal firearm. So if you hand in your expired firearm for destruction and they don't charge or prosecute you then you are fine.

    Granted the if they don't charge you is a big IF. If they do charge you then I'm sure they can use that to take the next step and completely disarm you.

    You are not likely to be charged if you go and hand it in voluntarily. Another matter if they find you in posession of your now illegal FA. If convicted, you will also automatically be declared unfit.

    I checked the FCA for compensation terms:

    COMPENSATION
    Circumstances where no compensation is payable in respect of
    firearms and ammunition forfeited to State
    134.
    No compensation is payable to a person in respect of a
    firearm or ammunition forfeited to the State in terms of this Act

    (a)
    if the relevant licence, permit or authorisation was cancelled in terms of this
    Act because the holder of the licence had contravened or not complied with a
    provision of this Act or a condition specified in that licence, permit or
    authorisation; or
    (b)
    if the holder of the licence, permit or authorisation became or was in terms of
    section 102 or 103 declared unfit to possess a firearm.

    My Legalese is not great but that looks like should you hand your firearm in voluntarily, there is no compensation for it.
    That will not sit well with a very large number of people

    If someone still has the old green card license and failed to renew the new white card, is the green card still valid or has the ruling been unclear on that?

    This ruling has nothing to do with the Arms and Ammunition act or the 2009 interim ruling
