Prodigal, to summarize and in a nutshell, the Applicant in that matter inter alia, asks the Court for relieve including:
1. A (mandamus) interdict to compel the DFO to accept the section 21 applications for temporary authorizations to possess firearms - the DFO refused to accept the said applications for processing or consideration;
2. An order compelling CFR to deal with those applications within the times intended by the FCA;
3. An order declaring such refusal to accept the applications as unlawful;
4. In this matter, the Applicant has been waiting for around one year for it's license applications to be finalized, and even longer for some competency certificates, therefore the Court is requested to rule on the issue of what would be reasonable, and to impose time frames for the finalization of these applications;
5. The Applicant also seeks an order to compel the CFR to process any further license applications that the Applicant will submit in future, in no longer than 90 days, and any temporary authorizations in no longer than 2 weeks, inclusive of the license cards / certificates being made available to the Applicants within the said time frames.
In other words, this matter covers a number of the issues currently experienced by the larger community.
CFR will have to explain what is going on. And perhaps for the immediate future reconsider their approach to their functions in terms of the FCA. And members of the community that are already suffering from these or related issues, should find the Court's recent expression on this matter invaluable in their participation in class suits to follow in the next month or so.
