    We appeared before Judge TP Mudau.
    From the onset, the state has not yet filed their answering affidavit in this matter. When the matter was called, the advocate for the state begged the court’s indulgence for a further postponement to allow the state time yet again to file their answering affidavit.
    Judge Mudau reluctantly agreed, stressing the fact that this matter has far reaching implications and may even reach the Constitutional Court. For this reason, the matter was postponed and the state was ordered to file their answering papers and a costs order was given.
    Going forward, we have decided to proceed with a Rule 41A process according to the Uniform Rules of Court. This is a mediation process in which an impartial and independent person (a retired judge in most cases) assists the parties to either resolve the dispute, or identify issues upon which agreement can be reached, or explore areas of compromise by facilitating discussions between the parties and assisting them in their negotiations to resolve the dispute.
    This will at the very least, allows us to talk to the SAPS to find a way forward. If a solution is found and agreed upon same is made an order of the high court by agreement. This is important as no appeal process can be made, as this is an agreed matter.
    Should this process fail, as the judge made it clear that this is a constitutional issue, we will proceed with a Rule 16A notice. Such notice requires a party raising a constitutional issue to prepare a notice (a ‘Rule 16A Notice’) containing a clear and succinct description of the constitutional issue raised. The notice after being stamped by the
    Registrar must be posted by the Registrar on a dedicated notice-board in the relevant High Court. One of the main purposes of the Rule 16A Notice is to inform those who may be interested in the constitutional challenge of the challenge. This opens the door for amici curiae to come forward to assist the court in providing additional information to come to a decision.

    This might be the inflection point we have been working to develop for years and years.

    A senior Judge, a States Attorney, and Counsel for the State all agreeing that the issue must be resolved.

    Coming on the heels of the Fidelity order (to which we contributed as Amicus), and the resulting Directive on expired licences (which we managed to influence via the drafting team at the CSP), this is all moving in a fantastic direction.

    GOSA has always said that if we can stop the State trying to hurt us, we win.

    Great message here, getting the younger generation involved, being involved with them and teaching them from pre-school that firearms are not evil and bad.

    Sorry that I looked half asleep... I was half asleep.

    Got up at 03h00. Drove 6 hours to Durban. Met people at the scheduled march start at Kings. Moved to Durban Central/KZN Provincial. Met with police. Drove 6 hours back to Johannesburg. Did live show at 17h30.
