SECTION 15 & 16 HANDGUNS AT ROADBLOCKS
Got this from NATSHOOT today ..
Dear Member
It has been brought to our attention that there is an increase in instances where SAPS at roadblocks seriously take people to task if they carry loaded section 15 or 16 licensed sport shooting or hunting handguns on their person while travelling.
SAPS takes it that one carries a loaded section 15 or 16 handgun on your person for self-defence when travelling.
At such roadblocks SAPS have indicated that section 15 and 16 handguns must be transported unloaded and in appropriate handgun cases, bags, or sleeves.
Section 13 handguns (self-defence) are not questioned when carried loaded on the person while travelling, as long as one has the licence with you.
Please also ascertain that you do not have loose cartridges in your vehicle for which you do not have the corresponding firearm licence with you. You can be taken to task for illegal possession if you cannot show a licence for the calibre of loose ammo in your vehicle.
Natshoot's advice has always been to rather act within the prescripts of the FCA (for your own peace of mind).

But that’s exactly what we all doing? Is it not?
I don’t see anywhere that it states you can’t carry a S15/16 in a holster?
I’m confused. As much as Natshoot me thinks.

Exactly, the act states that S13 firearms are the only firearms which can be stored loaded! Hence you can't store S15, S16 etc firearms loaded in a safe! Nowhere in the act does it say you may not transport a S15, S16 etc firearm loaded, it must just be kept under your control or in a bag/holster!

In 2017 Natshoot were very clear about this matter. But that was 5 years ago. The legal opinion they got is linked below.

The problem is trying to explain all this at a roadblock to someone who isn't competent to hold his post.

Yip, ask me who drove with a "expired" drivers license, despite the minister of transport giving extentions, making them valid. Not even showing them his video, saying it on the news, stopped them from slapping me with a R500 fine. At least it is renewed now, just waiting for it to be printed due to the huge backlog.

I'm confused on natshoot take on this when they've clearly stated previously that it lawful to carry a sec 15/16 firearm. Only time they unloaded is when they stored in safe

I can't find the originally quoted message on the NATSHOOT website, and also did not receive such a message from NATSHOOT?
