1) Who the Hell thought this was a good idea and something that Spain, and the world, needed?

Reading through the article makes one shake the head in wonder at how the mind of others work.

Not trying to understand their train of thought but instead tying to understand how they can justify that it is ok to essentially rape the animal and that it's OK as long as they don't hurt the animal...
Hurt the animal and then a charge can be laid.
