Selling a gun. Advise?
Hey guys / ladies,
I have a friend that sold their glock to a shop which in turn sold it to a new owner. My friend has for the past 11 month not received any money... as the buyer does not have a lisence yet.
What is the rule regarding this?
She wants her gun back....Who can I speak to?

First you going to get flack cause your first post is not in the introductions section,
Secondly, if your friend sold the gun to the shop, why would she not have gotten her money? Otherwise she did not sell it to the shop now did she?

Shop took in the gun to sell. They did not buy / pay for it.

some gunshops who sell for or on behalf of, will only pay for the gun once the applicant that paid the deposit or bought the weapon gets the license, this protects them against the applicant not getting the license and them getting stuck with the gun, but your friend should have signed an agreement to this effect when doing the deal at the beginning, perhaps they should read the fine print, if they did sign an agreement to sell on behalf of...

I got rid of a gun through a local shop a few years back. It was a sell on behalf and I new upfront I would only get my cash when the new owner got his licence. The shoptook 5%.
From an invoice for a gun I have just bought
"2. REFUNDS - No refund will be considered for any reason until such time as the said firearm has been re-sold and the NEW applicant is in possession of a legal firearm licence.
The following charges will apply to refunds:-
1.) Licence application refused by CFR:- 30% charge
2.) Purchaser requests refubd for any reason - 50% charge
I wish I could do business like that. If you are refused a licence the owner hold your cash till he gets another sake and that licence is approved and then you get 70%!

k, good luck, if for some reason, she did not sign any document, then i would assume that she has good legal standing to demand her money, in the past when licensing took 1-2 months, this was not a huge thing, but now with the loooong wait, i can well imagine that it is no longer a feasible or viable agreement for a seller to enter into.
