    Thanks @SSP, the Nuremberg angle was what was I was thinking of.

    Charging someone with a crime that they can't be convicted of because it doesn't apply whiffs a little of dereliction of duty, incompetence or corruption. Call me a cynic but I have the strong suspicion that the NPA's nominal/actual job gap is as wide as that of the metro cops.

    As far as I can remember a video showed him taking a rifle back from malema at least and I think it showed him handing it to him. Either way they fucked up/did what they should, depending on your view of what their actual job is and allowed a criminal to walk. They seem to have tried really hard to achieve the same for malema too.
