Thanks @SSP, the Nuremberg angle was what was I was thinking of.

Charging someone with a crime that they can't be convicted of because it doesn't apply whiffs a little of dereliction of duty, incompetence or corruption. Call me a cynic but I have the strong suspicion that the NPA's nominal/actual job gap is as wide as that of the metro cops.

As far as I can remember Snyman denied handing the firearm to Malema, and the state presented essentially no evidence or witnesses to support their claim that he did. The court made no finding as to how Malema came into possession of the firearm.

As far as I can remember a video showed him taking a rifle back from malema at least and I think it showed him handing it to him. Either way they fucked up/did what they should, depending on your view of what their actual job is and allowed a criminal to walk. They seem to have tried really hard to achieve the same for malema too.
