    Mahikeng - A man has been shot dead while breaking into a farmhouse at Doornhoek, near Zeerust, North West police said on Thursday.

    Brigadier Thulane Ngubane said a 65-year-old farmer went to investigate when his dog started barking on Wednesday night and found a man in the house.

    The farmer allegedly took out his gun and shot the man in the chest. He died on the scene.

    "Two cases were opened, one of housebreaking and the other one of murder," Ngubane said.

    "The farmer has not been arrested as the matter will be taken to the director of public prosecutions for a decision."

    before people freak out... opening a murder case is standard procedure.
    note that he wasnt arrested, which is always a good sign that it's not a witch hunt.

    Lekker Ooooooom! Daarsy! I am convinced, due to the heap of previous evidence, that he wasn't there to just burgle. If you try and break into a farm these days, you are taking a moerse chance.

    He killed the intruder intentionally, thus murder is more apt. It is not a clearly defined SD shooting, thus an inquest docket wasn't opened.

    Also,ALWAYS remember that the act does set out the conditions that have to be met where lethal force is allowed.Dammed if you,and dammed if you dont,glad to hear this farmer isnt yet another stat.

    Glad I'm not the one that had to make that decision whether to,or not to,squeese the trigger.Fear,adreneline,shock,or whatever emotions/physiological reactions he went through in that moment....

    Easy to "critisize",not ever(very fortunately) being in this guy's shoes,but if you've pulled that trigger and you start dialling the SAPS,you'd better start remembering all that boring stuff from when you did your competencies!

    Murder is the unlawful and intentional killing of another. Culpable Homicide is the unlawful and unintentional/negligent killing of another. Killing someone in private defence constitutes the LAWUL and intentional killing of another. So the difference between the two is the lawfulness of the act, which has to be proven first. That is why a murder case has to be opened.
