    Default Firearms form deseaced estate. What to do Please Help

    Hi There Guys

    My dad past away 3 months ago. He has 4 firearms

    2 of which I want to get deactivated
    1 I want to keep
    1 I want to sell

    Now We are in the process of getting the letter from the Master Of High Court to appoint my
    sister as Executor of the estate. This will take another month at least.
    My question is what do I do with these weapons in the meanwhile
    as I can not give them to any facility to keep without the necessary paper work that we are waiting for ?

    Do I just keep them until we have the paper work ?

    Technically you are in illegal possession of the firearms.
    Not sure on a deceased estate, but either the Attorney should be looking after them or they should be stored at your local cop shop.

    Anyone got more accurate info for Glocky?

    Problem is there is no Attorney as there is nothing in the estate beside the firearms and a bakkie all worth about 20 K

    Cop Shop is no option as these guns will be thrown in a room and will be damaged . I rather keep them illegally in that case

    I will gladly take them for storage and pay that , But they cant take them in without the letter of the master of the court
    which will take us about a month to 2 months to get

    Other options ??

    S21 permit.

    Do you have a competency? If so your DFO can give you consent to store.

    Hi Yes I have competency for all the weapons except 1 that I am doing on the 27th

    Glocky, if you meet the requirements of a Regulation 86(4), that you basically have a license and a safe, you could also go the Regulation 86(4) / SAPS539 route (basically permission to store a firearm). It's quicker, easier and cheaper (free in fact) and is approved at DFO level. You will have permission to store the gun(s) while the estate makes whatever other arrangements need to be made.

    I spoke to Rentia and she said the same she is sending me the correct info
    so I can go armed with that to Roodepoort DFO

    Where these arrogant SAPS member wanted to arrest me for illegal possession of fire arm

    Thanks for all the help guys

    Any idea how long this permit will be valid for or is that the DFO decision ?

    It's flexible and almost depends on the whim of the DFO and the mood he's in.  In that section of the SAPS539 application form (paragraph 7) make the period valid for a year.  If the DFO queries this just state that that's how long it could take sort out the estate, the sale and the license application, which isn't untrue.  Also, in the "reason for storage" portion of the application (paragraph eight) don't get too complicated, this isn't a motivation.  One or two sentences will suffice.

    If your DFO insists on making it valid for a shorter period then just swim along (three months seems to be the current SOP).  You'll just have to go there after the expiry date and get a new SAPS539.

    My aunt is in the same situation (3 guns from late uncle). She has given me the CZ as a gift and I made appl with the executor's letter attached and the fact that no one is contesting the CZ.
    SAPS have informed her that as long as the will is being wound up, she can legally keep all 3 firearms in the existing safe as she has got original licences for them.
