    Default Require support to resolve a stolen firearm case

    Good day all,

    Not able to post on the legal side of the forum, so i gave it a thought to post here if appropriate.

    My land Cruiser was stolen in 2013, with my pistol inside. All gone never found, nor Tracker could locate the pickup.

    Reported the case at Silverton police station, and a case was opened against me for negelance handling....
    I have heard noting about the case, was back at the police station (firearm center) about 10 times, left my number and details with the appropriate people in the office every time...i manged to get hold of the court documents (in archives) (2014) took it all to the firearm center in Silverton...again left my details with no feedback another 4 times..

    Is there any one whom can support me to finalize the details, i want to purchase more firearms, but sitting with a hindering obstical. How do i proceed from here ?

    The best is to see a good and knowledgable lawyer, yet I'll throw in a few thoughts: check whether the case is still open against you. If it has been thrown out, not logged or similar, continue as normal. If there is anything against you, lawyer up and brace yourself. Please keep us updated?

    The fresh application form will ask about the missing firearm, will it not?

    Yes it asks whether a, b or c ever happened to you / is applicable to you, but if there is nothing against your name it means that the police didn't file it or continue the investigation, which could mean that one is clean on their records.

    Wayne, was the firearm in a safe bolted to the body of the vehicle in compliance with SABS specifications?

    Will an application for a police clearance show if there are any pending cases against a person ? Does a Police Clearance show convictions or do they just decline to issue the document if there are convictions or pending cases ?

    Making a false statement on the app will have serious consequences if you get caught out.

    This is good advice and it's from a lawyer.

    It may just be better for you to enjoy the firearms you have, depending on how the weapon went missing, you may be declared unfit to posses.
