    Default Home owner 1, hijacker 0

    The neighbour of a colleague was involved in an attempted hijacking. Fortunately he won the firefight but took a bullet in his leg.
    I do not know the 'truth' behind the whole affair but it transpires that the deceased was a criminal with multiple warrants of arrest issued against him; and he was supposed be be in prison at the time of the crime. The homeowner has been advised to sue the minister of Law & Order hpy71 because a supposed incarcerated prisoner was on the loose preying on innocent victims.

    To all you legal eagles, what are his options?

    BTW, he was praised by the local SAPS for a job well done and his firearm was not confiscated.
    The victims accomplice (also shot) has been released from hospital without any further arrest etc confused0068.

    how was the hi-jackers accomplice alloed to walk??? it will be a case of 'de ja vu' if the accomplice goes out and comits a crime against another innocent victim...

    I hope that, if he proceedes with sueing the minister that he is successfull... or at the very least sees some sort of compensation of dr/physoi bills

    This isnt authoratative, but yes the homeowner would appear to have a right of action against the minister, who is vicariously liable for the actions of his underlings. Carmichael case stands as precedent. Approach an attorney.
