    Same senario but in SA.

    He shot the unarmered driver of the bike, what would happen? Murder?

    IMO no.
    Wasn't there a ruling people participating in a crime having to accept the consequences of their actions or something? The 'legal beagles' will pipe in shortly.

    It looks like he didn't draw the gun from his holster rather it was wedged down the side of the seat?

    Yes, I saw this a week or so ago, the article claimed he was using a car mounted holster
