Man shoots robber, has heart attack
Durban - A businessman suffered a mild heart attack after shooting a man who robbed his company in Pinetown, KwaZulu-Natal, on Tuesday morning, paramedics said.
ER24 spokesperson Derrick Banks said a group of men robbed a company that sells blinds in Westmead Road around 11:30.
"The suspects robbed the business and then escaped but were chased by one of the owners who shot and wounded one suspect," said Banks.
The businessman, in his mid-50s, suffered a mild heart attack after chasing the robber.
"He started getting chest pains. He was treated on the scene and then taken to hospital for a check-up."
The robber was taken to hospital under police guard in a serious condition.

well good for him, hope he pulls through ok, any time I read "The robber was taken to hospital under police guard in a SERIOUS CONDITION", is a good day in my books.

I hope for the mans sake that his shooting was justified.
He chased and shot one of the suspects...sounds like the immediate danger to life was over.

It also illustrates the need to keep in some sort of shape, other than round. Also have a question mark over the chasing suspect and planting him. But the news article is a little thin on detail.

Whether there was immediate danger or not is irrelevant. Immediate danger only plays a role when you act in selfdefence. This guy did not do this at this stage.
He was in the process of making a citizens arrest. And you can shoot a person if it is neccesary to subdue him or if he will evade arrest and you will not be able to arrest him without shooting him. BUT don`t kill him. As long as this BG does not die, the GG is in the clear !!!

Wismit, please elaborate on your source of this information, the law clearly states that a person is only safe under the act if using a firearm to protect life and not property, the fact the assailant was fleeing the scene constitutes manslaughter is in pretty big K@K if you as me.

Firstly it will only constitute manslaughter when the BG is killled. Then in these circumstances it will be murder. To be guilty of manslaughter you must kill a person negligently. This BG is here not dead. That is why I said don`t kill.
Then, Sect 42 of the Criminal Procedure Act 51/1977 (The one our courts use) states:
1) Any private person may without a warrant, arrest any person -
a)who commmits or attemp to commmit in his presence, or whom he
reasonably suspects of having committed an offence referred to in
schedule 1 of the Act.
b) ........
c) ........
Sect 49 of the same Act then states
1) If any person authorised under this Act to arrest a person and such
person -
a) resist the attempt and cannot be arrested without the use of force, or
b) flees when it is clear than an attempt to arrest him is made, or resist
such attempt and flees, the person so authorised may, in order to
effect the arrest, use such force as may in the circumstances be
reasonably necessary to overcome the resistance or to prevent the
person concerned from fleeing.
Sub Section 2 where you were given the right to kill another in order to prevent him fleeing has been declared unconstitutional.
